These Terms and Conditions are applicable to the use of your Debit Card (further – “Card”). It’s important to review these Terms and Conditions carefully before using your Card. By using it, you automatically agree to abide by these terms. If you disagree with these Terms, refrain from using your Card.
Your Card is provided by and remains the property of Clarity Solutions OÜ, registered at Harju Maakond, Tallinn, Lasnamäe Linnaosa, Peteburi tee 2c, 11415, Estonia with registration number 16240083. Your Card cannot be transferred to another person. Should you have any inquiries or grievances, please contact our Customer Service Department at support@clarity-solutions.io.
General Information:
Debit Card Services – We provide debit card services in cooperation with Wallester.com (“Wallester”) who is the Issuer of the Cards. When you complete the Submission Form, your request will be processed in collaboration with Wallester. You may be redirected to Wallester, which will contact you by email to continue the onboarding process. By submitting the form, you authorize us to share your relevant information with Wallester solely for the purpose of providing the credit card services.
Our Services allow you to access or connect with third-party services or products (“Third-Party Services”). If you choose to use any Third-Party Services, it is your responsibility to review and understand their applicable terms and conditions. We do not assume any responsibility or liability for the performance, availability, or content of any Third-Party Services. By approving these Terms and Conditions you also approve any third party applicable terms and conditions. Wallester has the right to unilaterally amend their applicable terms and conditions. The content of the changes will be communicated to you by us by giving you at least 2 months’ notice thereof (“Cancellation Period”).
Our Services may also contain links to third-party websites. The inclusion of such links does not constitute our endorsement, recommendation, or approval of those websites or their content. These websites are not governed by this Agreement, and you access them at your own risk. We expressly disclaim any liability related to such websites. Once you leave our Services and visit a third-party website, our Privacy Policy no longer applies. Your browsing and interactions on any third-party website, including those accessed through links provided in the Services, are governed by that website’s own terms, conditions, rules, and policies.
1. Definitions
- “Card” refers to the debit Card issued to you, whether in the form of a physical, digital, or virtual card, under these Terms and Conditions.
- “Card Account” indicates your electronic money account with us, linked to your Card.
- “Customer Services” can be reached via email: support@clarity-solutions.io.
- “Fees Table” refers to the table outlining fees associated with the Card, as displayed on the Website.
- “Merchant” denotes a retailer or any entity that accepts cards as payment for goods and/or services.
- “PIN” stands for a personal identification number, which may be issued or approved for use with your Card.
- “Global Clarity Cards” is a registered trademark and the trade name of Clarity Solutions OÜ, a company registered at Harju Maakond, Tallinn, Lasnamäe Linnaosa, Peteburi tee 2c, 11415, Estonia, with its registration number 16240083.
- “Terms and Conditions” encompass these Terms and Conditions along with the Fees Table, any supplementary terms, and amendments that may be notified to you occasionally.
- “Transaction” covers any cash withdrawal or purchase of goods and/or services made using your Card or any action affecting the balance of your Card Account.
- “Us,” “We,” or “Our” refer to Global Clarity Cards and Clarity Solutions OÜ.
- “Website” pertains to www.clarity-solutions.io.
- “You” or “Your” designates the legal entity entering these Terms and Conditions with us.
2. Fees
2.1. Your card usage is subject to the fees outlined in the Fees Table. These fees form part of these Terms and Conditions. We may waive or reduce any of these fees at our discretion. The fees we impose are subject to change over time, and we will notify you in advance of any such changes, as per Section 3.1. Additionally, your bank or Wallester may charge fees, and the ATM provider may levy additional ATM fees. Such fees and any other third party fees are separate from those listed in the Fees Table.
2.2. Any Fees incurred will be deducted from your Card Account when they are accrued.
3. Terms and Conditions
3.1. We reserve the right to amend Terms and Conditions, including Fees Table or introducing new ones, as necessary. We will provide you with at least two month’s notice before implementing any proposed changes unless they are advantageous to you, have no impact on your rights, or relate to exchange rates, in which case they will take effect immediately. All changes will be communicated via the Website and any other agreed-upon means.
3.2. The latest version of these Terms and Conditions will be available on the Website. It’s advisable to check the Website regularly to stay informed of any updates. By continuing to use your Card, you agree to abide by the latest version of these Terms and Conditions and any subsequent amendments. We recommend retaining a copy of these Terms and Conditions for your records.
3.3. Unless you notify us otherwise, you will be deemed to have accepted any changes we communicate to you. If you disagree with the changes and wish to terminate these Terms and Conditions, please inform us accordingly. In such cases, we will refund the balance on your Card Account without charging a refund fee.
4. Scope of these Terms and Conditions
4.1. These Terms and Conditions govern only the usage of your Card and Card Account in the scope of the relationship between you and us. The funds for all Transactions are held in your Card Account, and no interest will be accrued on these funds. When making a Transaction with your Card, the transaction amount and any associated fees will be deducted from your Card Account balance.
4.2. The funds loaded onto Your Card constitute electronic money. Your Card is not a credit card. You can only spend up to the value of the funds loaded onto your Card.
5. Card Issuance
5.1. The Cardholder must be at least 18 to use the Card. Before issuing your Card, your identity must be validated, including but not limited to your identity and home address.
5.2. We retain the right to refuse to issue you a Card.
5.3. Should you encounter any issues with your Card, please contact Customer Services at support@clarity-solutions.io.
5.4. Upon receiving a plastic Card, you must promptly sign it and follow the activation instructions provided. Your Card cannot be used until it is activated.
5.5. By these Terms and Conditions, we may permit you to have additional cardholders.
5.6. Any additional cardholder must also be at least 18 years old. You are responsible for providing proof of identity, including name, date of birth, and address, for any additional cardholder. You must obtain consent from any additional cardholder to share this information with us.
5.7. You are liable for any charges incurred by additional cardholders, and these Terms and Conditions apply to their Cards. You are responsible for ensuring that any additional cardholder complies with these Terms and Conditions.
5.8. You may request additional cards with a shared balance with the primary cardholder or a separate balance. As outlined in the Fees Table, we will charge a fee per additional Card. Both types of additional cards can only be funded through top-ups from the primary Card account. Transactions made on shared balance Cards will be deducted from your balance, while those made on separate balance Cards will be deducted from the balance on the respective additional Card.
5.9. If your Card Account is terminated, access to the balance will cease for any cardholder related to the Card Account, and all applicable Cards will terminate accordingly.
5.10 Wallester has the right to issue a new Card (replacement card). We shall inform you about the time and/or manner of receiving the new Card. If you do not want a new Card, you must notify us in writing at least 45 days before the last day of the month indicated on the Card.
6. Loading Your Card
6.1. Your Card may only be loaded through approved channels. The availability and nature of these channels depend on our commercial arrangements with partners. Details of these load channels specific to your Card can be found in the Fee Schedule. Depending on the loading method, a fee may be applicable (refer to the Fees Table for details). If you have questions about loading your Card, don’t hesitate to contact our Customer Services team.
6.2. Daily limits apply to Card Account loads and minimum and maximum load limits, as outlined in the Fees Table. We reserve the right to decline specific load transactions.
6.3. Once a payment or load is completed, it cannot be reversed. You are solely responsible for managing your Card usage.
7. Using Your Card
7.1. Your Card enables you to make purchases and withdraw cash from ATMs or financial institutions where accepted, provided sufficient funds are in your Card Account. The transaction’s validity can be verified online.
7.2. Spending and withdrawal limits apply to your Card usage; please refer to the Fees Table for specifics.
7.3. Please note that some ATM providers may levy additional fees, and certain Merchants may impose surcharges for using specific types of cards. You should also review their terms and conditions before proceeding with any transaction.
7.4. We retain the right to decline transactions at our discretion:
- We may suspend, restrict, or cancel your Card or refuse to issue or replace it for various reasons, including concerns about security, suspected unauthorised or fraudulent usage, legal compliance, or violation of these Terms and Conditions. If such actions are taken, we will inform you promptly and may request that you cease using the Card.
- If we refuse a transaction, we will strive to provide you with an explanation unless prohibited by law. You may rectify any information discrepancies by contacting Customer Services. We shall not be liable for Merchant refusals, unauthorised transactions, or our refusal to authorise transactions except where the law requires.
7.5. It’s your responsibility not to exceed the available balance in your Card Account. If an overspend occurs, you must reimburse us immediately. We reserve the right to deduct overspent amounts from any other Cards linked to your account or any funds subsequently added to your Card Account or between Card Accounts linked to you.
7.6. Upon notification of an overspend, you must repay it promptly. We may suspend your Card and associated Cards until the overspend is reimbursed.
7.7. Certain Merchants may pre-authorize transactions for an estimated amount exceeding the actual purchase value. Funds equivalent to the estimated sum may be held in your account until the Merchant finalises the transaction, typically within 30 days.
7.8. Merchants may be unable to authorise transactions without online verification from us. Refunds for purchases made with your Card will be credited back to the Card; cash refunds are prohibited.
7.9. Disputes regarding goods or services purchased with your Card must be resolved directly with the Merchant. If a purchase is unsatisfactory, you may have recourse against the Merchant, provided you notify us within 60 days of the transaction.
7.10. Authorising Transactions:
- A transaction is considered authorised if you follow the Merchant’s instructions to authorise it, which may include entering a PIN, signing a voucher, providing card details, or other methods.
- Authorised transactions cannot be revoked, except for those scheduled for a future date, which may be withdrawn if notice is provided before the close of business on the preceding business day. We may charge a fee for such revocations.
7.11. We reserve the right to apply a monthly maintenance charge, as specified in the Fees Table. You are responsible for all transactions and fees charged to your Card Account.
8. Foreign Currency Transactions
8.1. Transactions made in a currency other than your Card’s currency will be converted at the prevailing exchange rate on the transaction date, with a foreign exchange fee also applicable. Please refer to the Fees Table for details.
9. Disputed Transactions
9.1. You may be eligible for a refund for unauthorised transactions, incorrectly executed transactions, or transactions with amounts exceeding your reasonable expectations.
9.2. If you have any complaints, claims, or disputes related to the Card or any transactions made with the Card, please contact us immediately as your first point of contact. We will respond to your written complaint in writing or in a format that can be reproduced in writing. A reply will be provided within a reasonable time, but no later than 15 Business Days from the date your complaint is received.If, due to circumstances beyond our control, we are unable to respond within this period, we will inform you of the reasons for the delay and specify a new deadline for resolution. In any case, the final response will be provided no later than 35 Business Days from the date of receipt. We will assess your claim and, where appropriate, forward it to our issuing partner, Wallester, for further processing in accordance with Visa dispute resolution procedures. We or any Intermediary involved with providing the Services may be required to provide information to relevant regulatory authorities. By using our services, you acknowledge and agree that your information may be shared for compliance purposes as required by law. We are committed to ensuring that any information disclosed is accurate and provided in a timely manner.
9.3. If our investigation confirms the transaction’s validity, we reserve the right to charge you an investigation fee.
10. Card Expiry, Damage, and Replacement
10.1. Card is valid for the last day of the calendar month indicated on the Card . Upon expiry, you must request a replacement if desired.
10.2. If no replacement is requested or provided after expiry or if the Card Account is terminated, any remaining funds in your Card Account will remain accessible for 6 years, subject to a monthly maintenance fee. After 6 years, unrecovered funds will not be refunded.
10.3. Your Card’s validity extends until the stated expiration date unless terminated earlier by us or you.
10.4. Damaged cards may be replaced upon request, subject to a fee. You will need to provide card details for identification purposes.
11. Receiving Refunds
11.1. Any refunds for goods or services received using your Card will be credited to your Card Account balance.
12. Ensuring Card Security
12.1. It is your responsibility to keep your Card secure and not share it with others. Take reasonable precautions to prevent unauthorised use of your Card.
12.2. Upon receiving your PIN, memorise it and keep it confidential. Do not disclose your PIN to friends, family, or Merchant staff.
13. Liability
13.1. If you suspect unauthorised use of your PIN or Card, or if your Card is lost or stolen, promptly notify Customer Services.
13.2. Your maximum liability for unauthorised transactions on your Card is EUR 50 unless investigations show that you authorised the transaction, acted fraudulently, or were grossly negligent in safeguarding your Card or PIN.
13.3. You are not liable for losses from unauthorised transactions if you’ve exercised reasonable care in protecting your Card and PIN and promptly notified us of any unauthorised use.
13.4. We reserve the right to charge you for reasonable costs incurred in stopping Card usage or recovering owed funds.
13.5. Our liability is subject to exclusions and limitations, including circumstances beyond our control, compliance with laws, and data loss not caused by our wilful default.
13.6. Except as required by law or these Terms and Conditions, we’re not liable for unforeseeable losses resulting from our actions.
13.7. We’re not liable for the quality or delivery of goods or services purchased with your Card.
13.8. Interruptions to Card usage may occur during maintenance, limiting your ability to load funds, make purchases, or access transaction information.
13.9. If your Card is faulty, we’ll replace it with your loaded funds.
13.10. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill. We are not responsible for any actions or omissions of any other third party involved in the issuance, processing, or use of the Card.
13.11. Nothing in these Terms and Conditions limits our liability for death or personal injury or where prohibited by law.
14. Lost or Stolen Cards and Unauthorised Transactions
14.1. Treat the balance on your Card like cash in a wallet. If your Card is lost, stolen, or used without authorization, you may lose some or all of the funds on your Card Account, similar to losing cash.
14.2. If you suspect any unauthorised, erroneous, or incorrect Transactions on your Card, notify Customer Services immediately. We may request written details of your complaint.
14.3. You may need to assist us, our agents, or law enforcement if your Card is lost, stolen, or suspected of misuse.
14.4. If your Card is reported lost or stolen, we’ll cancel it and may issue a replacement, possibly subject to a fee.
14.5. If you find your Card after reporting it lost or stolen, destroy it and inform us immediately.
14.6. Refunds will only be issued after completing any necessary investigation. We reserve the right to withhold refunds if you haven’t followed these Terms and Conditions properly.
15. Statements
15.1. You can check your Card Account balance and Transactions on the Website anytime. Safeguard your login details; notify Customer Services promptly if you suspect unauthorised access.
16. Cancellation, Termination, and Suspension
16.1. Within 14 days of receiving your Card, you can cancel it without reason by contacting Customer Services. No cancellation fee will apply, but you won’t receive a refund for authorised or pending Transactions or Card fees.
16.2. Depending on how you choose to receive your remaining Card Account balance, a fee may be deducted (see Fees Table).
16.3. You can cancel your Card without penalty during the Cancellation Period or if you disagree with a proposed amendment . Cancelling at other times may incur a fee.
16.4. Notify Customer Services to cancel your Card; you’re responsible for any Transactions or charges before cancellation. We’ll block the Card immediately upon notification.
16.5. Destroy your cancelled Card by cutting it in half through the chip and magnetic strip.
16.6.
16.7. We may suspend or terminate your Card and these Terms and Conditions immediately if you breach them, use the Card negligently, fraudulently, or unlawfully, fail to comply with applicable laws, regulations, or rules, or pay fees or charges, if you have been ceased to be our client or at our sole discretion.
16.8. These Terms and Conditions end upon your death.
16.9. If your Card Account has a positive balance upon closure, the remaining funds will be returned to you as instructed (minus applicable fees) unless the funds are restricted.
16.10. We can suspend your Card immediately if the provided information is incorrect or incomplete or if a Transaction is declined due to insufficient funds.
16.11. You agree to repay any Transactions, fees, or charges incurred after cancellation or termination immediately upon demand.
17. Personal Data
17.1. Your personal data processing follows our Privacy Policy, which is available at https://clarity-solutions.io/privacy-policy. Accepting these Terms and Conditions implies agreement with our Privacy Policy terms.
18. Your Details
18.1. Promptly inform us of any changes to your name, address, phone number, or email. We’ll use the most recent contact details provided by you for any communication regarding your Card. Failure to update your contact information relieves us of liability.
19. Complaints Procedure
19.1. Express any dissatisfaction with our service in writing to Customer Services (support@clarity-solutions.io). We handle all queries according to our complaints procedure, accessible on the Website or upon request.
20. Customer Services
20.1. Our Customer Service operates from 8:00 am to 5:00 pm (EST), Monday to Friday. Lost and Stolen reporting is available 24/7. Conversations with Customer Services may be recorded for training and monitoring purposes. Global Clarity Cards provides Customer Services on behalf of Clarity Solutions OÜ.
21. Miscellaneous
21.1. Headings in these Terms and Conditions are for convenience only and do not affect interpretation. Our delay or failure to exercise any right or remedy under these Terms and Conditions doesn’t waive that right or remedy for future use.
21.2. You cannot transfer your rights or obligations under these Terms and Conditions. We reserve the right to transfer or assign Our rights or obligations without notice. If you don’t wish to transfer, contact us to terminate your Card and Account, with any remaining balance refunded per our redemption procedure. We may subcontract any obligations under these Terms and Conditions.
21.3. This Agreement constitutes the entire agreement between you and us concerning the subject matter and supersedes all prior communications, understandings, or agreements, whether oral or written. The rest remains in full force if any part of these Terms and Conditions is deemed unenforceable.
21.4. You’re responsible for complying with these Terms and Conditions until your Card and Account are closed and all sums due are paid.
21.5. These Terms and Conditions are in English only. In the case of translation, the English version prevails. In case there are any discrepancies concerning Card related matters between Wallester Card Terms and Conditions and our Terms and Conditions, Wallester Term and Conditions shall prevail.
21.6. These Terms and Conditions are governed by Estonian law, and you agree to the jurisdiction of Estonian courts.
21.7 You agree to indemnify, defend, and hold us harmless from and against all liabilities, losses, damages, claims, and expenses (including reasonable legal fees) arising from your use or misuse of the Card or Services, your violation of this Agreement and your breach of any applicable law or rights of any third party.
21.8 We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, power failures, or government actions.
21.9 All content, trademarks, logos, and intellectual property displayed in connection with the Services are owned by us or our licensors. You may not use, copy, or reproduce any part of our Services without prior written consent.
